welcome to drape! these terms of use ("terms") govern your access to and use of the drape mobile application and related services (collectively, the "service"), operated by Drape ("drape," "we," "us," or "our"). our service includes an AI-powered virtual try-on experience, a digital wardrobe manager, and personalized outfit suggestions.

please read these terms carefully. by downloading, installing, or using drape, you agree to be bound by these terms. if you do not agree, do not use the service.

1. eligibility

you must be at least 13 years old to use drape. if you are between 13 and 18 (or the age of majority in your jurisdiction), you may only use the service with the consent of a parent or legal guardian who agrees to be bound by these terms on your behalf. by using the service, you represent and warrant that you meet these requirements.

we do not knowingly collect personal information from children under 13. if you believe a child under 13 has provided us with personal information, please contact us at hello@weardrape.app so we can promptly remove it.

2. description of the service

drape is a fashion technology app that helps you organize your wardrobe, discover outfit inspiration, and visualize how clothes look on you using AI. core features include:

some features require a paid subscription and use credits that are consumed with each AI generation. details are described in the subscriptions section below.

3. accounts and registration

guest mode

you may begin using drape without creating an account. in guest mode, your wardrobe data and photos are stored locally on your device only. drape is not responsible for any loss of locally stored data (for example, if you delete the app or change devices). to unlock AI-powered features and cloud storage, you must create an account and subscribe to drape pro.

registered accounts

you may create an account using Apple Sign In or email. you are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. you agree to notify us immediately at hello@weardrape.app if you suspect unauthorized access to your account.

you may delete your account at any time from the profile screen within the app. upon deletion, we will permanently remove your profile data, uploaded photos, AI-generated images, and associated files from our servers. active subscriptions must be cancelled separately through Apple — see the subscriptions section below.

4. subscriptions and billing

drape pro

drape offers an optional auto-renewing subscription ("drape pro") that unlocks AI-powered features, including virtual try-on, AI wardrobe beautification, AI metadata extraction, outfit detection, and monthly credits for AI generations. drape pro is available in monthly and annual plans at the prices displayed in the app at the time of purchase. prices are subject to change; you will be notified in advance of any price increase.

apple in-app purchase terms

all subscription purchases are processed through Apple's in-app purchase system. by subscribing, you agree to the following:

introductory offers

we may offer introductory pricing or promotional offers from time to time. eligibility for introductory offers is determined by Apple and is limited to one per Apple ID. at the end of the introductory period, your subscription will automatically renew at the standard rate unless you cancel at least 24 hours before the introductory period ends.

cancellation and refunds

you may cancel your subscription at any time through your Apple ID Account Settings. cancellation takes effect at the end of the current billing period — you will retain access to pro features until then. we do not offer partial refunds for unused portions of a billing period. for refund requests, please contact Apple Support directly, as all payments are processed by Apple.

5. credits

drape pro subscribers receive a monthly allotment of credits (currently 30 credits per month) that are consumed when using AI-powered features such as virtual try-on and image generation. each AI generation typically costs one credit.

6. user content

"user content" means any photos, images, or other materials you upload to or create within drape, including selfies, body photos, and wardrobe item photos.

ownership

you retain all ownership rights in your user content. drape does not claim ownership of any photos or images you upload.

license to drape

by uploading user content, you grant drape a limited, non-exclusive, royalty-free license to process, store, transmit, and display your content solely for the purpose of providing and improving the service. this license is limited to what is technically necessary to operate the service — for example, sending your photos to third-party AI services to generate try-on images, storing wardrobe photos in your cloud account, and displaying your wardrobe within the app.

we do not use your photos or personal content to train AI models. your images are processed only to fulfill your specific requests (such as generating a try-on image) and are not retained by third-party AI providers beyond the time needed to complete the generation.

this license terminates when you delete the relevant content or your account. upon account deletion, we permanently remove your uploaded photos and associated data from our servers.

7. AI-generated content

"AI-generated content" means images and other outputs created by the service using AI technology, including virtual try-on images, beautified wardrobe photos, and AI-generated user models.

ownership and use

AI-generated content created through your use of drape belongs to you. drape does not claim ownership of your AI-generated try-on images or other outputs. you are free to save, share, and use your AI-generated content for personal, non-commercial purposes.

you agree not to use the service to:

we reserve the right to suspend or terminate your account if we reasonably believe you have violated these terms, with or without prior notice.

9. intellectual property

the service, including its design, features, content, branding, graphics, user interface, and underlying technology, is owned by drape and is protected by copyright, trademark, and other intellectual property laws. you may not copy, modify, distribute, sell, or lease any part of the service without our prior written consent.

"drape" and the drape logo are trademarks of drape. nothing in these terms grants you any right to use our trademarks, service marks, or trade dress.

10. privacy

your privacy is important to us. our privacy policy describes how we collect, use, store, and protect your personal information, including your photos and AI-generated content. by using the service, you agree to the collection and use of your information as described in the privacy policy.

11. third-party services

drape relies on third-party services to provide its functionality, including cloud infrastructure, authentication, AI image generation, subscription management, and analytics. these third-party services have their own terms and privacy policies.

drape is not responsible or liable for the availability, accuracy, or content of any third-party services. your use of the service may be subject to additional terms required by our third-party providers.

12. copyright infringement (DMCA)

if you believe that content available through the service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent:

your notice must include:

counter-notification

if you believe that content you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification to hello@weardrape.app with the subject line "DMCA Counter-Notification." your counter-notification must include your name, address, telephone number, identification of the removed material, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake, and your consent to the jurisdiction of the federal court in your district (or San Francisco County, California, if outside the U.S.). we will process counter-notifications in accordance with the DMCA.

13. disclaimers

the service, including all AI-generated content, is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

without limiting the foregoing, drape does not warrant that:

AI-generated content is for personal reference and entertainment purposes. it should not be relied upon as an accurate representation of garment fit, color, or appearance. you acknowledge that AI technology is inherently imperfect and may produce unexpected results.

14. limitation of liability

to the maximum extent permitted by applicable law, in no event shall drape, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with your use of (or inability to use) the service.

drape's total aggregate liability for all claims arising out of or relating to these terms or the service shall not exceed the greater of (a) the amounts you paid to drape in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

these limitations apply regardless of the legal theory (contract, tort, strict liability, or otherwise), even if drape has been advised of the possibility of such damages. some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

15. indemnification

you agree to indemnify, defend, and hold harmless drape and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

16. dispute resolution

informal resolution

before filing any formal dispute, you agree to first contact us at hello@weardrape.app and attempt to resolve the dispute informally for at least 30 days. most concerns can be resolved this way.

binding arbitration

if we cannot resolve a dispute informally, you and drape agree to resolve any claims relating to these terms or the service through final and binding arbitration, except as set forth below. the arbitration shall be conducted by JAMS under its Streamlined Arbitration Rules and Procedures, and shall take place in San Francisco, California, or at another mutually agreed location.

class action waiver

you and drape agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. if this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

exceptions

either party may bring a claim in small claims court if the claim qualifies. either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

opt-out

you may opt out of binding arbitration within 30 days of first accepting these terms by sending a written notice to hello@weardrape.app with the subject line "Arbitration Opt-Out" and including your name, email address, and a clear statement that you wish to opt out.

17. governing law

these terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws provisions. any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

18. termination

we may suspend or terminate your access to the service at any time, with or without cause, and with or without notice. grounds for termination include, but are not limited to, violation of these terms, fraudulent or abusive activity, or extended periods of inactivity.

upon termination:

you may terminate your account at any time by deleting your account through the profile screen in the app.

19. changes to these terms

we may update these terms from time to time. when we make material changes, we will notify you by updating the effective date at the top of this page and, where appropriate, through an in-app notification. your continued use of the service after the revised terms take effect constitutes your acceptance of the changes. if you do not agree to the revised terms, you must stop using the service and delete your account.
